How the date is worked out

Note (2), Chapter XII, Supreme Court Rules, 2013: where a number of days is prescribed by the Rules or fixed by an order of the Court, the day from which the period is reckoned is excluded; and if the last day expires on a day when the Court is closed, that day and any succeeding days on which the Court remains closed are also excluded.

So for a 90-day period, the order date is day 0 and the 90th day after it is the last day — an order of 1 January runs out on 1 April. If that day is a Saturday, Sunday or court holiday, the last day moves to the next day the Court is open. Holidays in between do not count for anything; only the closure on the last day matters.

Court holidays are taken from the Supreme Court calendars for , the same data as the Court Holiday Planner. Summer partial court working days are treated as days on which the Court is closed. If you applied for a certified copy, the days from the date of application to the date the copy was made available are added to the period (s.12(2), Limitation Act). The calculator does not deal with condonation of delay. Always verify against the official calendar and the Rules before filing.
